The courts in England have a very wide discretion when deciding what a divorce and finances settlement should be. They have to achieve a 'fair' outcome. Our approach

This can be broken down into four stages:

Protect

The first thing we do is protect your position by ensuring that your husband or wife does not dispose of assets before the financial settlement is agreed. We will also ensure that you have sufficient resources to meet your most pressing needs while we negotiate your financial settlement.

Disclose

Next, we insist on obtaining full disclosure of your husband or wife's assets and income. We work closely with the country's top forensic accountants to trace undisclosed assets or to value business or trust interests. We also work closely with surveyors to ensure that property valuations are accurate.

Negotiate

Once you are satisfied that full disclosure has been given, we then negotiate hard for you to ensure that you obtain the financial settlement you deserve. Depending on the assets involved, it may be necessary to involve a tax adviser at this stage to structure the settlement tax efficiently.

In the vast majority of our cases, there is no need for court proceedings, which can be time-consuming, stressful and expensive. We are committed instead to resolving cases by negotiation – we also offer the Collaborative Family Law option to resolve divorce and finances disputes.

Implement

Once the settlement has been decided on, it then has to be implemented. We can also involve a financial adviser at this stage to recommend how best to invest your settlement.
